  • Family Immigration Law:

Under the Immigration and Nationality Laws (INA) there might be certain benefits for a United States Citizen (USC) or Legal Permanent Resident (individuals with green cards) to help reunite their family. We help apply for various types of visas depending upon the facts and circumstances of each immigrant situation. In addition to helping families with various types of visas, we also help entities to bring in qualified workers, such as skilled workers or religious workers. A VAWA petition can be filed by an abused male or female spouse or child of a United States Citizen or Green Card Holder. Aliens who are victims of crime may be entitled to self-petition by use of a U visa. Visa petitions and immigration law is complicated. You should also contact an immigration lawyer when you or your alien relatives receive a Notice to Appear (NTA). An NTA is the initiation of removal proceedings in Immigration Court when a person is arrested and detained by immigration officials or local police on the suspicion of not having lawful immigration status. Often the alien is arrested first by local law enforcement or Immigration Customs Enforcement (ICE) officers and then given a Notice to Appear. The alien whom the NTA is issued is the respondent. Arrest and detention and the issuance of the Notice to Appear is the initial phases of the Immigration Court Proceedings; and typically the next step is an immigration appearance bond hearing in Immigration Court. Sometimes an alien can be placed in removal proceedings as the result of tax issues. For example, The United States Supreme Court ruled on February 21, 2012 in Kawashima v Holder that violations of 26 U.S.C. §§7206(1) and (2) are crimes “involving fraud or deceit” under 8 U.S.C. §1101(a)(43)(M)9i) and are therefore aggravated felonies as that term is defined in the Immigration and Nationality Act, 8 U.S.C. §1101 et seq, when the loss to the Government exceeds $10,000.
